1. Acceptance of Terms

By accessing or using Servy ("servy.uz", "servy.app", the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and Servy ("we", "us", "our"). By creating an account, subscribing to a plan, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

Servy is a software-as-a-service (SaaS) platform that enables small businesses to deploy AI-powered chatbots. The Service provides:

  • AI chatbots powered by retrieval-augmented generation (RAG) technology that answer customer questions based on your business knowledge base and product catalog
  • Multi-channel deployment across Web (embeddable chat widget), Instagram Direct Messages, and Telegram
  • A dashboard for managing knowledge bases, product catalogs, conversations, analytics, team members, and channel configurations
  • API access for custom integrations

The Service is provided on a subscription basis. Features, channels, and capabilities may be updated, modified, or expanded over time.

3. Account Registration

To use the Service, you must create an account. By registering, you agree to the following:

  • Accurate information: You must provide truthful, accurate, and complete information during registration and keep your account information up to date.
  • One account per person: Each individual may only create and maintain one account. Creating multiple accounts to circumvent plan limits or for any other purpose is prohibited.
  • Age requirement: You must be at least 18 years of age to create an account and use the Service.
  • Password security: You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access or security breach.

We reserve the right to suspend or terminate accounts that violate these requirements.

4. Subscription and Billing

All payment processing, billing, tax calculation, and invoicing for the Service is handled by Paddle, our Merchant of Record. When you subscribe to a paid plan, you are entering into a billing relationship with Paddle. Paddle's terms and privacy policy apply to all payment transactions.

  • Free trial: All new accounts receive a 14-day free trial with full access to all features. No credit card is required to start the trial.
  • Auto-conversion: At the end of the 14-day trial, your account will automatically convert to a paid subscription on your selected plan unless you cancel before the trial period ends. If no plan is selected, your account will be paused.
  • Pricing: All prices are listed in US Dollars (USD). Applicable taxes are calculated and collected by Paddle based on your location.
  • Billing cycle: Subscriptions are billed monthly or annually, depending on the billing period you select. Renewals are automatic unless canceled prior to the renewal date.
  • Invoicing: Paddle issues all invoices and receipts directly. You can access your billing history and invoices through the Paddle customer portal.

5. Plans and Limits

Servy offers the following subscription plans:

  • Starter: 1 business, 2 team members (owner + 1)
  • Pro: 3 businesses, 5 team members (owner + 4)
  • Custom: 4 or more businesses, configurable team member count

All plans include all features: unlimited conversations, all channels (Web, Instagram, Telegram), unlimited knowledge base items, product catalog, advanced analytics, custom branding, human handoff, multi-language support, and API access. The only difference between plans is the number of businesses and team members.

6. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited messages, spam, or bulk communications through the chatbot or any connected channel
  • Engage in, promote, or facilitate any illegal activity, including fraud, money laundering, or the sale of prohibited goods or services
  • Impersonate any person, business, or entity, or misrepresent your affiliation with any party
  • Harass, threaten, defame, or intimidate any individual or group
  • Circumvent plan limits, usage restrictions, or security measures through any technical or non-technical means, including creating multiple accounts
  • Resell, sublicense, or redistribute access to the Service or any part of it without prior written consent from Servy
  • Upload malicious code, viruses, or any content designed to disrupt or harm the Service or its users
  • Use the Service in any manner that could damage, disable, or overburden our infrastructure

Violation of this policy may result in immediate suspension or termination of your account without prior notice.

7. AI Disclaimer

The Service uses artificial intelligence (AI) and large language models to generate chatbot responses. While we strive to deliver accurate and helpful answers based on the knowledge base and product catalog you provide, please be aware of the following:

  • AI may produce errors: AI-generated responses may occasionally contain inaccurate, incomplete, or outdated information. The quality of responses depends in part on the completeness and accuracy of the knowledge base you provide.
  • No liability for AI responses: Servy is not liable for any decisions made, actions taken, or damages incurred based on AI-generated responses. You are responsible for reviewing and verifying the accuracy of your chatbot's output.
  • AI disclosure is mandatory: You must not present AI-generated responses as human-written communications. Your chatbot must clearly identify itself as an AI assistant to end users. Removing or hiding AI disclosure notices is a violation of these Terms.

8. Intellectual Property

Servy platform: The Service, including its design, code, features, documentation, branding, and all associated intellectual property, is owned by Servy. You may not copy, modify, distribute, sell, or create derivative works based on any part of the platform without our prior written consent.

Your business data: You retain full ownership of all content you upload to the Service, including knowledge base items, product catalog entries, business information, and chatbot configurations. By using the Service, you grant Servy a limited, non-exclusive license to process this data solely for the purpose of providing the Service to you.

End customer messages: Messages sent by your end customers through the chatbot belong to those end customers. You are responsible for handling end customer data in compliance with applicable privacy laws and regulations.

9. Data Ownership and Portability

We believe your data belongs to you. You have the right to:

  • Export your data: You may export your business data, knowledge base, product catalog, and conversation history at any time through the Service dashboard or by contacting our support team.
  • Request deletion: Upon request, we will permanently delete all of your data from our systems within 30 days. This includes backups and any cached copies. Deletion is irreversible.

After account termination, we retain your data for 30 days to allow for account recovery or data export. After this period, all data is permanently deleted.

10. Service Availability

We aim to maintain 99.9% uptime for the Service, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice whenever possible)
  • Urgent security patches or critical updates
  • Factors beyond our reasonable control, including third-party service outages, network issues, or force majeure events

We will make commercially reasonable efforts to minimize downtime and notify users in advance of any scheduled maintenance that may affect the Service.

11. Limitation of Liability

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, Servy shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, business opportunities, or goodwill
  • Service downtime or interruptions
  • Errors, inaccuracies, or omissions in AI-generated responses
  • Third-party service outages (including OpenAI, Instagram, Telegram, or Paddle)
  • Unauthorized access to your account resulting from your failure to secure your credentials

In no event shall Servy's total aggregate liability exceed the amount you have paid to Servy in subscription fees during the twelve (12) months immediately preceding the event giving rise to the claim.

12. Termination

By you: You may cancel your subscription and terminate your account at any time through the dashboard settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date.

By Servy: We may suspend or terminate your account immediately and without prior notice if you violate these Terms, engage in prohibited activity, or pose a risk to the security or integrity of the Service. In cases of minor violations, we will attempt to provide notice and an opportunity to remedy the issue before termination.

Data retention after termination: Following account termination, your data will be retained for 30 days to allow for data export or account recovery. After this 30-day period, all data will be permanently and irreversibly deleted from our systems.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Uzbekistan, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved in the competent courts of the Republic of Uzbekistan.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Provide at least 30 days' advance notice via email to the address associated with your account
  • Update the "Last updated" date at the top of this page
  • Post the revised Terms on our website

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and terminate your account before the changes take effect.
